Your post and the law
EB has more than 200,000 members. Many of the forums can be viewed by guests. This means there is always a chance that someone involved in a court case will be reading. Remember that anything you post is published, therefore it has the potential to affect the outcome of legal proceedings. We need to be very careful about what is posted in the forums and we ask all members to note the forum rules. This is an extract:

QUOTE
Contempt of court
The law of contempt of court aims to prevent the publication of material which risks prejudicing a fair trial or breaches a court order.

Subjudice contempts involve the publishing of information either with the intent to interfere with the course of justice or which has a tendency to interfere with the course of justice. Examples of this form of contempt include publishing material that may prejudice jurors or the judge, influence witnesses or prejudge an accused's innocence or guilt.

What can I post?

Please keep the discussion about crimes and court cases to what has been reported publicly, not what you may have heard from "a friend of a friend who knows someone..." This includes mentioning an accused person's previous criminal record. This sort of information is prejudicial - it could influence a juror and therefore jeopardise someone's right to a fair trial. An example: No one would want to see the trial of a paedophile or murderer aborted because of unauthorised information and/or rumours being circulated publicly, but this is a possibility if we are not careful about what is posted on EB.

A person who is facing charges is innocent until proven guilty, so comments presuming guilt (eg, "rot in hell" or "throw away the key") are not appropriate.
A person whose name has been suppressed by the court or withheld to protect the identity of victims must NEVER be identified in a post.

The restrictions on discussing crimes and court proceedings are relaxed somewhat after a person has been found guilty or if they have pleaded guilty. But this does not mean a free-for-all.

The bottom line: If in doubt, leave it out! Please contact a moderator or administrator if you have any questions or if you see something on the boards that worries you.
