> Unpaid paternity leave?

Just wondering if anyone has any advice for me.

My husband is looking to take a week off work unpaid when bubs is born. His boss is telling him he isn't entitled to any leave because he hasn't yet worked there for a 12 months on a full time contract.

Can he really refuse to give my husband unpaid time off for the birth of our baby? I've read that fathers are entitled to three weeks unpaid leave, but nothing about having to work for the company for 12months before hand. Does anyone have any further information for me?

Everything Fair work has in regards to 'parental leave' has the 12 month requirement

Can he take annual leave or simply apply for leave without pay instead?

I'm pretty sure it's accrued - go to fairwork website - or call them and explain the situation - they will help you out . How long has he been in the job??

This is the same at my husband's workplace. It's managers discretion as to whether they allow any unpaid leave for fathers (no relation to service years).

However, he is, and your husband would be too, as it is a minimum guideline, to allow family sick leave. Which is paid. So he could make a statement and call in sick and they would have to pay him. So long as he can get a medical certificate they can't not allow this.
