> Penalty rates, is this dodgy?

I have a strong suspicion that some kids i know are being taken advantage of re penalty rates and other things.

i was always paid public holiday rates, even for casual jobs. It was double time. I was also paid penalties for sundays, was time and 20. This was in businesses that openend 7 days a week. These kids get no penalties at all for public holidays and sundays.

In addition, any discrepancies in the till is taken out of their pay. (and no, anything over is not added to their pay) I think this is not allowed. The rule was with all the businesses I worked at, $5 either way, okay, if it was over this, you got a warning.

So it's been a few years since I last worked. This is QLD. I realise things could have changed, but it doesn't right to me. WDYT.

It depends what award they are on and if part time or casual .


I've had teenagers as staff in the past as part timers, no penalties for Sunday or PHs but 6 weeks leave a year to even it out.

It does depend what award they're on but penalty rates on Public Holiday are petty standard. I'm also pretty sure that docking their pay fro till discrepancies is actually illegal. They need to contact Fair Work Australia and ensure that they know their rights.

I agree with PPs - penalty rates depends on the award / agreement. When I was working casual (fast food sector) there was no penalty for nights, weekends or public holidays.

Docking pay for till discrepancies is definitely illegal. If the store manager has a problem with till balances, then it is a performance management issue to be dealt with by warnings etc. Get advice from Fair Work Australia or the relevant union.

Nothing more to add, because PP's have said the right thing about Public holidays and sundays.

As for money being taken from their wages, this is close to theft! I was involved in a situation many years ago where the employer was criminaly charged for doing this. It's tha same with taking money for breakages. Not on under any circumstances!

This depends on their award - they may get increased regular pay or something to make up for it.

thanks for the help. It's a corner store. Even when i was working at a pizza shop, still gave double for public holidays, no night penalties though.

I've never had a job where you weren't paid double for public hols though- actually never heard of it anywhere on an hourly rate apart from days off in lieu for salaried employees.

I might have a word to the kids about the fair work australia site. They are only young 14/15 so might be a heads up for their next jobs.

This is something I'm trying to figure out for myself right now. I'm reading through the entire modern award for my job, as it is I've never been paid extra on public holidays even though I've worked many. If it's the fast food industry modern award you're looking for here is a link.
