We bought a car yesterday. The woman who sold it to us, sent us the VIN by SMS. We checked it out and it matched the car's colour etc and was all OK. We then returned to her and paid her the price in cash, and drove the car away.

When we went to insure the car, DH noticed the VIN was not the one she gave us...

It turns out on further check the car was written off after a collision in February this year. It was then 'inspected' a couple of weeks ago.

We would not have bought the car had we known this fact. We are not used to being ripped off, and I am a bit cross. As it is Sunday none of the paperwork has been registered yet.

Is it worth getting legal advice to try to get our money back?

Are you talking about a car you bought for $500, or many thousands of dollars?

Edited as didn't correctly read your post.

Yes I would contact the police/take legal action.

A tough lesson to learn in terms of being really thorough when you buy a car.

I would probably call the police, as that is fraudulent. I'm not sure if they will do anything, but it is worth a shot.

Geez, that's no god. But really you should sight the VIN yourself, never trust anyone else. Did she send you a PIC of the VIN?

She's not the devil, but she wears his best dress
You paid for a car without checking the vehicle details yourself first? And paid $8k in cash for it??

ETA: It's a buyers beware market - you failed to do the checks (properly), I don't see how you have much of a leg to stand on

My war paint is Sharpie ink
That's terrible. I wonder if it's some kind of fraud. You agreed to purchase a vehicle with that VIN, not another one. So your verbal contract is voided perhaps? I'd get some legal advice, perhaps starting with the licensing people with regards to what to do about the paperwork for transfers.

I would get legal advice and I would get the police involved because what she did is illegal. She could be potentially be dealing stolen property and you could get yourself in hot water too.
