|
The question is in relation to a neighbours above ground pool. They don't have a pool fence, but the pool is not on top of the boundary fence (6ft thereabouts), it is a good distance from it (not great with estimating measurments?!). Just wondering if they are required to have a pool fence?

I thought any pool deeper than 30cm needs to be fenced...

Depends on the state for the legalities you're in but my fist answer is yes they need a fence.

|
I believe there is something about climbable sides/presence of ladders/presence of other climbable objects. If none if that is a problem, provided the sides of the pool are high enough, they can act as their own fence.
It would be a rare situation, though, where there was no ladder or handy chair around I came across this in my research for fencing requirements if a blow up pool. Will see if I can find a link |

It depends on which state you're in, in nsw you're still required to have a full pool fence http://www.fairtrading.nsw.gov.au/Consumer...quirements.html
Some other states it's ok if the entry ladder is fenced |

Can I also please add onto the OP and ask whether a spa needs to be fenced? I'm in QLD and not my spa my in laws but the refuse to fence it.

As an OP said if there is no removable ladder to climb they don't need a fence. If there is a ladder they do need a fence.

Thanks for the replies. I don't want to get on the bad side of neighbours, we have only ever said hi to them over fence as they are at back of us. But I need to ensure the safety of not only our child but others who come here, as well as those who visit their home.
I will phone council and go from there. |

If you click on the link that Smoo provided for NSW, you will see that the rules vary depending on when the pool was built. Pool fencing laws The requirements for child-resistant barriers vary depending on when the pool was built and where the pool is located. For pools built before 1 August 1990 Access to the pool from the house must be restricted at all times. Windows and doors may form part of the barrier, but they must be compliant. For pools built after 1 August 1990 but before 1 July 2010 The pool must be surrounded by a fence that separates the pool from the house. Some exemptions apply to pools on very small properties (less than 230 square metres), large properties (2 hectares or over) and those on waterfront properties. For pools built after 1 July 2010 All new pools must be surrounded by a fence that separates the pool from the house. To anyone with questions: PLEASE reach out to Kat Plint (hannabug on EB), who leads Hannah's Foundation, with specific questions, as she is a recognized expert in water safety & drowning prevention. She can give you expert advice with regards to what steps to take when you have concerns that a neighbour or relative is not being compliant with fencing/safety laws.
