Anyone else's 2012/2013 cruise plans now cancelled due to the CIC voluntary administration?
To say I'm gutted is an understatement. We booked this cruise to Bali on Athena for our 10 year wedding anniversary. I've never been on a cruise before. No idea what we're going to do now, if anything. We have to wait for the outcome from the administrators first. Now we're just hoping we're going to get our money back. Has anyone had to go through with trying to get money back from a holiday booking? RAC travel are currently in talks with the company but who knows what will happen & if/when we'll see the money. We paid with our credit card so have travel insurance through that. Wondering if we should just go ahead and make a claim without waiting for the administrators decision? The insolvency process can take a long time and most of the time creditors do not get all there money back. If I was you I would make a claim on your insurance, the insurance company can then deal with the administrator.

The insurance may require that the company is in liquidation before paying out.
VA is just where the administrators come in to assess the business (usually because they are in danger of trading insolvent). Within 21/28 or so days (can't remember) the administrators give a report to creditors and recommend whether control be handed back to the directors, the administration continue or to place the company in liquidation. So even if they tell you to wait, it won't be too long. |

Some insurers may require the insolvency process to resolve before making a claim, others however may pay out now and then seek to recover the costs from the administrator/liquidator. I think it is worthwhile at least asking the insurer if a claim can be made now. |

I think it is worthwhile at least asking the insurer if a claim can be made now. That is obscene to suggest that the insolvency process needs to resolve! For one thing, a resolved insolvency process to me would indicate that all available money has been distributed and the company has been deregistered. I worked in an office which had a 10 year insolvency file still going on (litigation was ongoing). Definitely contact insurer and make a claim if you can. I was just saying that even if they tell you that you have to wait for the company to go into liquidation, that it won't take too long and not to stress. |

Thanks all. I spoke to Commonwealth bank today and they said I can put in a claim whenever I want. It takes them 45 days to investigate and then get back to us. She said sometimes the administration process can be quicker but after hearing about other insolvency issues in the media where people get back 20c in the dollar etc maybe it's best to try through insurance?
Argh, I don't know! I've never had to deal with a thing like this before. Our travel agent tells us to sit tight but I'm scared |

Make sure your insurer covers for Insolvency - some of them don't these days - good luck with your claim.

If you have been advised the trip is cancelled then I would put in the insurance claim. It doesn't really matter where you get money refunded from as long as you do and I would think that travel insurance will provide the fastest solution with the greater chance of getting a full refund. They can then deal with the administrators.

Yes, we are in the same position - our cruise on Athena has been cancelled, according to the latest statement from the Administrators (here) http://www.lawlerpartners.com.au/creditor_...s/new_job/index
We are still waiting to hear from our travel agent to this effect, as they told us on nov 1 that the only money at risk was our deposit ($150 out of a total payment of $1,950). This was all that had been sent to the cruise company, and our final payment was still in the travel agent's client fund. They have had us sign a proof of debt form for our deposit, which was supposedly lodged at the first meeting of creditors yesterday. If you can access the link, this sets out all your options for redress. I think I may just show up at my travel agent's office with this press release and demand the money that they have assured me is still in their bank account! Hope all is not lost with you, and that this info helps. |
