Ok long story short - hopefully.

Went through some issues with child in regards to personal protection. Father didn't visit with child for a while and finally mediation was done to which an agreement came to place to keep child safe.

Consent orders have now been written up by fathers lawyer, but are a bit different to what was actually mediated. The important facts were kept in consent orders which keep child safe.

Mother asked for two extra things in light of the orders not being an exact of what was mediated.

1. Food not used as punishment as child is extremely underweight.
2. Child not to be smacked.
3. Child given option to bath alone as child asked for this by self. (although mother is willing to leave this one out and allow child to fight this one for itself)

Is mother overreacting? Should she bother fighting for childs rights? If she doesn't sign consent orders matter will most likely go to court?

How does mother go about finding a decent Family lawyer on limited money?

Legal aide are just suggesting to sign or try ADR.
Mediation was initially through private registered mediator who will now grant a certificate to begin court proceedings.

Call legal aid. They should help you out.

Was the mediation through them or Relationships Australia/Family Relationships Centre?

Why are you asking EB for legal advice? Ask your lawyer for heaven's sake.

Good lord, your ex is such a gutless w*n*er!!!! rant.gif rant.gif He is so under the thumb of new wife wacko.gif

All of your requests 1-3 are reasonable and new wife who would deny them is on such a power trip. She better hope the shoe isn't on the other foot one day when it's her childs rights she is fighting for.

Can you find a private lawyer who does a percentage of pro bono work or will let you have an account to pay off?

Mirror, mirror, shiny glass, tell me that is NOT my ass!!
Hard to say whether the mother is over reacting when there is no story behind why she has pointed those 3 things out.

1. Food not used as punishment as child is extremely underweight.

What do you mean? If she only wants junk food to eat and is not allowed, give it to her anyway because of her weight issues? Or if she's been naughty, she doesn't get fed?

2. Child not to be smacked.

I understand this one!

3. Child given option to bath alone as child asked for this by self. (although mother is willing to leave this one out and allow child to fight this one for itself)

With an adult or child??

Your requests as the childs Mother are very reasonable. I cannot see a judge denying these. If money is tight you can represent yourself at court, in some cases the court will even appoint someone to assist you free of charge. However, if these are the three things that you are trying to establish I can't see you having any trouble as the Judge will see that you only have your childs best interest at heart.

Good Luck original.gif
